# PolaPop Terms of Service and End User License Agreement

These Terms of Service and End User License Agreement ("Terms") govern your access to and use of PolaPop, a mobile instant photo camera app that turns the iPhone Dynamic Island area into a playful instant-photo viewfinder and print outlet experience (the "App" or "Service").

The App is operated by JoCoding, Inc. ("PolaPop", "we", "us", or "our").

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protection rules, you may also have rights under your local law. Nothing in these Terms limits rights that cannot legally be waived.

## 2. What PolaPop Does

PolaPop is a camera and photo creation app. The current product concept includes:

- taking photos with the device camera;
- applying film-style filters and PolaPop visual effects;
- creating an instant-film-style digital photo output;
- showing a Dynamic Island-inspired in-app printing animation;
- storing in the App, viewing, sharing, exporting, and deleting photos created in the App;
- purchasing or earning "Film Sheets", a virtual consumable used to create additional photos;
- subscribing to PolaPop Plus, if offered, for recurring Film Sheets and member benefits; and
- watching rewarded ads, if available, to receive limited free Film Sheets.

Current capture features require camera permission. Commerce, account protection, rewarded ads, restore, and support features may require network access, in-app purchases, iOS 17 or later, and compatible iPhone hardware. The current App uses local in-app photo storage and system sharing/export controls; it does not currently request photo-library permission. For the best visual experience, we recommend iPhone 14 Pro or later Dynamic Island-equipped iPhone models. The Dynamic Island-inspired visual effect is simulated inside the App, and PolaPop does not require system-level Dynamic Island control to provide its core camera and instant-photo features.

## 3. Acceptance of These Terms

By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the App.

If you use the App on behalf of a company or another organization, you represent that you have authority to bind that organization to these Terms.

## 4. Eligibility and Children

The App is not directed to children under 13. If your local law sets a higher age for parental consent to use online services, you may use the App only with the required permission from a parent or legal guardian.

If you are under the age of majority in your country, you may use the App only with permission from a parent or legal guardian.

If you are in the EEA or UK and local law requires parental consent for online services below a higher age, you may use the App only with the required parental or guardian consent.

## 5. Privacy and Permissions

Your use of the App is also governed by our Privacy Policy.

The App may request access to your camera so that you can take and create photos. You can manage permissions in your device settings. The current App stores created photos locally inside the App and uses system sharing/export controls when you choose to share them. If we add optional photo-library saving later, we will request any required permission before using that feature.

We do not claim ownership of your personal photos. Photos you create remain yours, subject to the limited rights needed to operate features you choose to use, such as local storage, sharing/export, support, or future backup or cloud features if such features are added.

## 6. End User License

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions, Family Sharing, and volume purchasing rules where applicable.

You may not:

- copy, modify, distribute, sell, rent, lease, sublicense, or commercially exploit the App;
- reverse engineer, decompile, or disassemble the App except where applicable law permits;
- remove copyright, trademark, or proprietary notices;
- use the App to violate law or third-party rights;
- interfere with the App, servers, payment systems, ads, analytics, or security features; or
- attempt to bypass Film Sheet balances, subscriptions, ad reward limits, or purchase validation.

## 7. Apple App Store Terms

These Terms are between you and us, not Apple. We are solely responsible for the App and its content.

Apple has no obligation to provide maintenance or support for the App. To the extent any maintenance or support is required by applicable law, we are responsible for it.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if any, according to Apple's rules. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.

We, not Apple, are responsible for addressing claims relating to the App or your possession and use of the App, including product liability claims, regulatory claims, consumer protection claims, privacy claims, and intellectual property claims.

You represent and warrant that:

- you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as supporting terrorism; and
- you are not listed on any U.S. Government prohibited or restricted party list.

You must comply with applicable third-party terms when using the App, including Apple terms, wireless carrier terms, payment terms, RevenueCat terms if applicable, AdMob or ad network terms if applicable, and any platform rules that apply to your use.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.

## 8. Accounts, Device Data, and Restore

Some features may be device-based and may not require a traditional email account. However, the App may create or use a backend account identifier through Supabase to manage Film Sheet balances, capture spending, purchase grants, rewarded-ad grants, fraud prevention, and recovery.

Before paid consumable Film Sheet purchases or rewarded-ad grants, we may require Sign in with Apple to protect your backend account. This helps us link your Film Sheet ledger to a durable Apple identity so eligible balances can be recovered after reinstalling the App or switching devices.

You are responsible for keeping your device, Apple ID, and any account credentials secure.

If purchase restoration is available, it is intended to restore eligible purchases associated with the Apple ID, RevenueCat user ID, or backend account used for the original transaction. Auto-renewable subscriptions may be restored through App Store and RevenueCat status. Consumable Film Sheets are generally not restorable through the App Store alone and may be recovered only if our backend ledger can identify the same user or if applicable law requires it.

If you request account deletion or deletion of your personal information, we may delete or de-identify your service account, Film Sheet balance, and ledger records, except where we need to retain transaction, dispute, security, or legal compliance records. After account deletion, unused Film Sheets may no longer be recoverable.

## 9. Film Sheets and Virtual Items

Film Sheets are virtual consumable credits used inside the App to create PolaPop photo outputs.

Film Sheets:

- have no cash value;
- are not money, stored value, gift cards, securities, or property;
- cannot be sold, transferred, exchanged, or redeemed for cash;
- may be consumed when you create a photo or use a paid feature; and
- may be subject to balance, fraud prevention, restoration, or abuse checks.

We may offer starter Film Sheets, paid Film Sheet packs, subscription Film Sheets, promotional Film Sheets, or rewarded-ad Film Sheets. The actual number of Film Sheets, pricing, availability, regions, and product configuration shown in the App, App Store, or RevenueCat purchase flow controls over any general description in these Terms.

Film Sheet balances are managed through our backend ledger. App Store, RevenueCat, webhook, network, fraud-prevention, or server delays may cause a purchase or reward to appear later than the App Store purchase confirmation. We will make reasonable efforts to verify and apply delayed eligible purchases or rewards.

## 10. In-App Purchases

The App may offer in-app purchases through the Apple App Store, including consumable Film Sheet packs and subscriptions.

All App Store purchases are processed by Apple. Apple may charge applicable taxes. Prices, billing terms, refunds, and cancellation flows may be shown by Apple and may vary by country or region.

You agree to pay all charges shown to you before confirming a purchase.

We do not directly collect or store your full payment card number, bank account number, or similar payment credentials. To validate purchases, grant Film Sheets, process refunds, provide support, and prevent abuse, we may process transaction identifiers, product IDs, purchase status, refund status, cancellation status, and subscription status provided by Apple, RevenueCat, or our backend ledger.

## 11. Subscriptions

If PolaPop Plus or another subscription is offered:

- the subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period, unless Apple displays different terms for your country or product;
- your Apple ID account will be charged for renewal according to Apple's rules;
- you can manage or cancel subscriptions in your Apple Account settings;
- deleting the App does not automatically cancel a subscription;
- cancellation takes effect at the end of the current paid period unless Apple or applicable law provides otherwise;
- subscription benefits may change for future billing periods with notice where required by law; and
- monthly and annual subscription plans may be offered, and an annual plan may bill annually while still granting Film Sheets monthly.

Before asking you to subscribe, we will describe what the subscription includes, the billing period, the price, and any trial or promotional terms in the App Store purchase flow or in the App.

## 12. Rewarded Ads

The App may allow you to watch rewarded ads to receive free Film Sheets.

Reward availability is not guaranteed. Rewards may be limited by region, device, network availability, daily limits, ad network policy, anti-fraud checks, and technical conditions.

You may not use automation, emulators, modified clients, scripts, VPN abuse, repeated resets, or other manipulation to obtain ad rewards or bypass reward limits.

If an ad fails, is unavailable, or cannot be verified by the ad network or our systems, we may be unable to issue the reward. Rewarded-ad grants may also require account protection, daily limits, duplicate-event checks, and fraud-prevention review.

## 13. Refunds and Cancellations

For purchases made through the App Store, refund requests are handled by Apple according to Apple's policies and applicable law. You can request a refund through Apple's support channels.

We may provide support information, but we do not control Apple's refund decisions for App Store transactions.

For subscriptions, cancellation stops future renewals but does not automatically refund the current paid period unless Apple or applicable law provides otherwise.

If a consumable Film Sheet pack is refunded, reversed, or cancelled, we may remove the corresponding unused Film Sheets from your balance. We will not make your balance negative solely because you already used refunded Film Sheets, but suspected fraud, abuse, or chargeback activity may result in limits on future purchases, rewards, or capture features.

## 14. EU, EEA, and UK Consumer Withdrawal Rights

If you are a consumer in the EEA, UK, or a jurisdiction with similar consumer rules, you may have a right to withdraw from a distance contract within 14 days without giving a reason.

For digital content or digital services supplied immediately, you may lose the withdrawal right once performance begins if you expressly consent to immediate performance and acknowledge that you lose the withdrawal right, where such acknowledgement is required by law.

Because App Store purchases are processed by Apple, withdrawal and refund requests for App Store purchases should generally be submitted through Apple's refund process. This does not limit mandatory rights you may have against us under applicable law.

## 15. User Photos and Content

You own the photos and content you create or import into the App.

You are responsible for the photos you take, save, share, export, or upload using the App. Do not use the App to create, store, or distribute content that:

- violates law;
- infringes copyright, trademark, privacy, publicity, or other rights;
- is abusive, harassing, defamatory, exploitative, or harmful;
- contains illegal sexual content or child sexual abuse material;
- impersonates another person or misleads others; or
- violates platform, App Store, ad network, or third-party service rules.

If the App later supports public sharing, feeds, community features, cloud galleries, or user profiles, additional content rules may apply.

## 16. Intellectual Property

The App, software, design, interface, visual effects, logos, icons, text, animations, and brand assets are owned by us or our licensors and are protected by intellectual property laws.

PolaPop, the PolaPop logo, and related branding may not be used without permission.

Third-party trademarks, including Apple, iPhone, App Store, Dynamic Island, Polaroid, RevenueCat, AdMob, Google, and any other third-party names, belong to their respective owners. Reference to third-party products or services does not imply endorsement unless expressly stated.

## 17. Third-Party Services

The App may integrate with third-party services, SDKs, or platforms, such as Apple App Store, StoreKit, RevenueCat, Supabase, Google AdMob, analytics, crash reporting, cloud storage, or device APIs.

Your use of third-party services may be governed by their terms and privacy policies. We are not responsible for third-party services that we do not control.

## 18. Updates and Changes to the App

We may update, modify, suspend, or discontinue features of the App.

Where required by law, we will provide notice of material changes that negatively affect your paid access or consumer rights.

Updates may be required for security, compatibility, legal compliance, bug fixes, App Store review requirements, or new platform versions.

## 19. Service Availability

We try to keep the App reliable, but we do not guarantee uninterrupted or error-free operation.

Some features may be unavailable because of device limitations, camera permissions, operating system changes, App Store issues, payment provider issues, ad inventory, network conditions, or maintenance. If a future version adds optional photo-library saving, that feature may also depend on photo-library permission.

## 21. Warranty Disclaimer

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.

We do not warrant that the App will meet your expectations, be uninterrupted, be error-free, preserve every photo, or be compatible with every device, operating system, camera mode, or App Store configuration.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

## 22. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, photos, profits, revenue, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for claims relating to the App or these Terms will be limited to the greater of:

- the amount you paid us through the App in the 12 months before the claim; or
- USD 50.

This limitation does not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, fraud, intentional misconduct, or mandatory consumer rights.

## 23. Indemnity

If you use the App for business purposes or violate these Terms, you agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, costs, and expenses arising from your misuse of the App, your content, your violation of law, or your infringement of third-party rights.

This section does not apply to consumers where prohibited by applicable law.

## 24. Termination

You may stop using the App at any time. You may delete the App from your device, but deleting the App does not cancel App Store subscriptions.

We may suspend or terminate access to features if you materially violate these Terms, misuse payments or rewards, compromise security, or if required by law or platform rules.

Where required by law, we will provide notice and an opportunity to respond unless urgent action is needed for security, legal, fraud prevention, or user safety reasons.

## 25. Changes to These Terms

We may update these Terms from time to time.

If changes are material, we will provide reasonable notice through the App, App Store metadata, our website, or another appropriate method. If required by law, we will ask for your consent.

Your continued use of the App after the effective date of updated Terms means you accept the updated Terms, except where applicable law requires a different process.

## 26. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except that mandatory consumer protection laws of your country of residence may still apply.

If you are a consumer, you may bring claims in the courts required or allowed by your local mandatory consumer law.

If you are not a consumer, the state and federal courts located in Delaware, United States will have exclusive jurisdiction, unless applicable law requires otherwise.

## 27. Miscellaneous

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign or transfer these Terms without our consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or by operation of law.

These Terms, together with the Privacy Policy and any purchase terms shown by Apple or in the App, make up the agreement between you and us regarding the App.
